Terms and Conditions for Auto Empire

1. Introduction
Welcome to Auto Empire (“we”, “us”, “our”). By accessing or using our website at autoempirex.com (the “Website”) and making an offer or purchase, you agree to comply with and be bound by these Terms and Conditions (“Terms”). If you do not agree to these Terms, please do not use our Website or services.
2. Definitions
Vehicle: A motor vehicle available for purchase on the Website.
Buyer: The person or entity making an offer or purchasing a Vehicle.
Offer: The price proposed by a Buyer for a Vehicle.
Sales Agreement: A legally binding contract that both the Buyer and Auto Empire will sign when an Offer is accepted.
3. Eligibility
By using our Website, you confirm that you are at least 18 years old and legally capable of entering into binding contracts. If you are acting on behalf of an organization, you confirm that you have the authority to bind the organization.
4. How It Works
Browse Vehicles: Buyers can explore our curated selection of fully inspected, hand-selected classic and collectible vehicles.
Make an Offer: Buyers can submit an Offer for a vehicle through the “Make Offer” button. You must agree on the price with our sales team before submitting an Offer.
Order Registration: Upon acceptance of an Offer, Buyers will register their order, submitting necessary information, including a photo of their driver’s license.
Sign the Sales Agreement: After registration, the Buyer will receive and electronically sign the Sales Agreement.
Invoice & Payment: After signing the agreement, the Buyer will receive an invoice containing bank details. Payment must be made via wire transfer within 48 hours.
5. 8-Day Money-Back Guarantee
Eligibility: Buyers may return the vehicle within 8 calendar days of delivery, provided it remains in the same condition as when delivered (no modifications, damage, or excessive wear).
Return Procedure: The Buyer must contact Auto Empire’s customer support at sales@autoempirex.com
- Return Shipping: Auto Empire covers return shipping costs if the return is eligible, but the Buyer must pay a $250 delivery fee and a $150 processing fee for returns.
6. Shipping and Delivery
Nationwide Delivery: Shipping is included in the purchase price for most listings, and our logistics department manages the delivery.
Delivery Timeline: Delivery times are estimates and are subject to delays. Once the payment is received, shipping or pick-up will be initiated.
7. Payment Terms
Wire Transfer: All payments are to be made via wire transfer within 48 hours of receiving the invoice.
Failure to Pay: Failure to complete payment within 48 hours will result in the cancellation of your order.
8. Vehicle Warranty
Each vehicle comes with a 3-month or 1,000-mile warranty (whichever comes first), covering only mechanical defects that are not caused by external damage or misuse.
9. Limitations of Liability
Auto Empire is not liable for any indirect, incidental, or consequential damages arising from using the Website or the purchase of a Vehicle. Our liability is limited to the purchase price of the Vehicle.
10. Governing Law
These Terms will be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law principles.
11. Dispute Resolution
Any disputes arising from these Terms will be resolved through binding arbitration in Brooklyn, NY.
12. Modifications to Terms
Auto Empire reserves the right to update these Terms at any time. Any changes will be posted on the Website, and the updated Terms will be effective upon posting.
